This website, www.polishedbagspa.com.au (the “Site”), is owned and operated by Samantha Milne‑Loxton, trading as Polished Luxe Bag Spa (ABN 17902759799), operating from our studio at 18 Eden Street, North Sydney, NSW 2060, Australia (“we”, “our”, “us”).
The terms “you”, “your”, “client”, and “user” refer to any individual who accesses the Site or engages with our services.
These Terms of Service (“Terms”) govern your use of the Site and all services provided by Polished Bag Spa. By accessing the Site or using our services, you acknowledge and agree to be bound by these Terms. If you do not agree, you must refrain from using the Site or our services.
1. Definitions

“Item(s)”: handbags, wallets, small leather goods and accessories submitted for our Services.

“Services”: cleaning, repairs, restoration, colour work, protection, mould/odour remediation and related assessments.

“Customer”, “you”, “your”: the owner (or authorised agent) of the Item(s).

“Courier”: any third party used for the carriage of Item(s).

“Assessment”: our inspection to determine suitability, risks, pricing and timeframes.
2. Quotes, Orders & Approvals

2.1 Quotes are indicative until we complete an Assessment upon receipt of your Item(s). If scope, risks or pricing change, we will seek your written approval before proceeding.

2.2 A confirmed order exists only once you have paid as set out in clause 3 and we have sent a Work Confirmation.

2.3 We may refuse an order where risks are unacceptable, parts are unavailable or the Item is unsuitable.
3. Pricing & Payment

3.1 Prices are in AUD.

3.2 Full payment is required prior to commencement, unless we agree otherwise in writing.

3.3 If additional work is requested after approval, a revised quote will apply.
4. Timeframes

4.1 Estimated timeframes are provided in good faith and may change due to complexity, material behaviour, parts sourcing or workshop capacity.

4.2 We will keep you informed of material delays.
5. Customer Responsibilities

5.1 Provide accurate information and clear photos during quoting; disclose known defects, prior treatments and repairs.

5.2 Remove all personal belongings from Item(s). We accept no responsibility for items left inside.

5.3 Ensure your return address and contact details are correct.
6. Service Limits & Risks (Important)

6.1 Leather, suede, nubuck, patent and coated canvases carry inherent risks (e.g., colour‑fastness, top‑coat reactivity, historical dye transfer, micro‑cracking). Outcomes cannot be guaranteed.

6.2 Where foreseeable, we will explain risks and seek your consent before proceeding.

6.3 Minor variances in finish/colour, acceptable within professional tolerances, do not constitute defects.
7. Warranty on Workmanship

7.1 We warrant our workmanship and materials for six (6) months from collection/dispatch.

7.2 This warranty excludes general wear and tear, misuse, exposure to adverse conditions and post‑service incidents.

7.3 Our obligation under this warranty is limited to re‑work or refund of the service fee, at our discretion.
8. Parts, Materials & Colour

8.1 We aim to match colours and materials closely; exact matches may be impossible due to ageing or limited availability.

8.2 Branded hardware/parts may be replaced with high‑quality equivalents where original parts are unavailable.
9. Delivery, Collection & Risk in Transit

9.1 If we arrange Courier services, shipments are tracked and, where available, signature‑on‑delivery is used.

9.2 Risk transfers to us only once an Item has been received and accepted by Courier and transfers back to you upon dispatch to your nominated address. If you self‑ship or nominate your own carrier, you bear transit risk unless we have expressly agreed otherwise in writing.

9.3 Where we arrange insured carriage, any claim for loss or damage in transit is limited to the applicable insurance payout and subject to the insurer’s conditions (including proof‑of‑purchase, declared value and evidence requirements).
10. Limitation of Liability

10.1 While an Item is in our physical care, our Maximum Liability per Item will not exceed the LOWER of:
-
(a) the applicable insurance payout available to us under our policy(ies) for the relevant loss; or
-
(b) the proven depreciated value of the Item immediately prior to the loss or damage.

10.2 Where no insurance cover responds (including where insurer conditions such as proof‑of‑purchase, declared value, or evidence requirements are not met), our liability remains limited to the proven depreciated value of the Item.

10.3 We are not liable for any indirect or consequential loss, nor for loss/damage outside our physical custody or after dispatch, except where required by law.
11. Change of Mind, Cancellations & Refunds

11.1 If we have not commenced work, you may request cancellation for a refund less reasonable admin/shipping costs.

11.2 Once work has commenced, refunds are not available except where required by law.

11.3 If we cannot proceed due to unforeseen risks, we will return the Item and refund the service fee less incurred shipping.
12. Photos & Marketing Usage

12.1 We capture before/after images for quality assurance.

12.2 With your consent, we may use de‑identified images for marketing; you can withdraw consent at any time.
13. Force Majeure
We are not liable for delays or failure due to events beyond our reasonable control.
14. Australian Consumer Law
Nothing in these Terms excludes or limits any rights you have under the Australian Consumer Law.
15. Privacy
We collect, store, and use personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
16. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Disputes are subject to the exclusive jurisdiction of the NSW courts.
